Description of Practice

ALAN (A/K/A "WILLIE") BORST mediates and arbitrates commercial and insurance disputes involving securities, shareholder rights, mergers and acquisitions, creditors rights and bankruptcy, workplace (wrongful termination, discrimination, sexual harassment, disability), professional negligence including Directors and Officer (D&O) liability, errors and omissions (E&O) and legal malpractice . He has recently been accepted as a non-public FINRA arbitrator. He has extensive experience in securities class actions arising out of IPO’s and after market trading. As a former insurance and reinsurance company vice president I have resolved all kinds of insurance coverage issues such as allocation of indemnity and defense costs, intercompany disputes, aggregate and “clash” coverage, non-recourse and settlements without consent, coverage exclusions for illegal conduct, personal profit, insider trading and allegations of “bad faith” or unfair insurance practices. I have experience with new insurance products, tech E&O and cyber liability as well as insurance of private equity, public company and non-profit and educational entities and associations.

Professional Background

WILLIE BORST has 25+ years of experience in resolving, through negotiation, litigation and ADR, progressively more complex commercial disputes including insurance and reinsurance claims for carriers and policyholders. As an attorney and company representative for major insurance and reinsurance carriers he has participated in settlement of hundreds of complex corporate governance disputes involving breach of fiduciary duty, violations of federal securities laws, bankruptcy, ERISA, FCPA, EEOC, as well as breach of contract, IP licensing, trademark, copyright, data breach and data privacy. His background also includes property and casualty losses under commercial general liability and BOP policies including claims for personal injury and property damage, advertising liability, business interruption and coverage of pollution (including Superfund), asbestos and hazardous waste and environmental impairment.

Degrees

Mr. Borst is a graduate of the Carey School of Law, University of Maryland, where he was Executive Editor of the International Trade Law Journal, and received his B.A., with honors, In French Literature and Political Science at the University of Michigan, Ann Arbor. He studied abroad as a junior at Michigan earning a certificate, from the Insitut d'Etudes Politiques, Paris, France. He speaks Italian and Fluent French.

Approach

My approach is facilitative to the extent the parties appreciate the strengths and weaknesses of their own positions. In my experience objective evaluation is my strength as a mediator, however, so I will attempt to move parties from their "comfort zones" to avoid impasse and foster a true dialogue that leads to settlements in a wide variety of commercial and insurance disputes.

Fees

$400 per hour, half-day minimum. ($250 per hour for workplace liability and wrongful termination).
