I truly believe that conflict resolution, particularly through mediation, is the most efficacious method of resolving disputes. I utilize a combination of both evaluative and facilitative techniques, depending upon the nature of the case and the personalities involved, and attempt to utilize transformative mediation skills where appropriate. For example, I mediated a family dispute over the nonpayment of a loan. There were no significant legal issues involved in the dispute, but there were many years, and many layers, of family dynamics impacting resolution of the case. Ultimately, using facilitative techniques, I did assist the parties in settling their case, but I also referred them to family mediation because their dispute went beyond the issues in the lawsuit. As another example, a plaintiff who was a professional musician was bit on the hand by a cat. The attorneys for both the plaintiff and the defendant were not well versed in applicable legal principles. I assisted both sides toward an understanding of the legal issues involved in the case, and was ultimately successful in reaching a settlement, utilizing evaluative methods. I hope I used transformative mediation methods in obtaining conflict resolution in both cases.
